8. Supplier responsibility and warranty - Seller's liability for defects
8.1 The manufacturer of each product you buy is responsible for any damage due to a defect in its product. Any agreement limiting or exempting the manufacturer from his liability is void. Claims against the manufacturer for damage shall be forfeited three years after the injured person has been informed or should have been informed of the damage, defect and identity of the manufacturer. After a decade the product has been released, the rights of the injured party against the manufacturer are extinguished. In case of doubt as to the identity of the manufacturer of a product you have purchased from us, please contact us.
8.2 Any lasting consumer goods are accompanied by the written warranty of the manufacturer of the product or the company that imported the product into the EU or the undertaking affixing its mark on the product as a manufacturer (the "supplier"). Please pay particular attention to the terms of the warranty provided by the supplier as well as to the other accompanying documents and particulars which, under the responsibility of the supplier, are included in the products and in particular those relating to the safe use and maintenance of the products. We particularly emphasize the following:
- 8.2.1 The supplier must provide the consumer written or internationally well-established symbols, clear and complete instructions for the safe use, preservation, maintenance and full use of the product and information on the risks during use and maintenance.
- 8.2.2 The guarantee must include, in simple, legible and comprehensible terms, at least the name and address of the guarantor, the product to which the guarantee refers, its exact content, its duration and the extent of its territorial validity. The guarantee must be in accordance with the rules of good faith and not be denied by excessive exceptions clauses. The duration of the warranty must be reasonable in relation to the probable life of the product. The likely product life is the reasonably foreseeable time for the product to be used in accordance with its intended purpose, even after repair or replacement of spare parts, until the wear from regular use renders the product useless or economically unprofitable from further use. Specifically for cutting-edge technology products, the duration of the warranty must be reasonable in relation to the time at which these products are expected to remain technologically modern if this is shorter than their probable life span.
- 8.2.3 If a defect occurs on the product during the period of validity of the warranty and the supplier refuses or delayes repairs beyond the time necessary, the consumer is entitled to request replacement of the product with the same features and quality or, if not repaired, to request a withdrawal from the contract. If the required repair time exceeds fifteen (15) working days, the consumer is entitled to request the temporary replacement of the product for as long as the repair lasts. The breach by the supplier of his obligations does not affect the validity of the warranty which the consumer may invoke and require the supplier to comply with it. In case of replacement of the product or its replacement, the warranty is automatically renewed for the entire duration of the new product or replacement.
- 8.2.4 In addition to and beyond warranty, the supplier of new lasting consumer goods must ensure that consumers will be continually provided with technical services for their maintenance and repair, for a period equal to the probable life span. Also, the supplier must ensure that consumers are able to obtain the spare parts and other products required for their use according to their purpose for the entire life span.
- 8.2.5 In application of the above provisions, P.A. SOLUTIONS, if it is the seller of a product as defined above, will provide you with all possible assistance to fulfill the supplier's warranty terms without charge. This is true regardless of the non-warranty maintenance service, which we may provide as appropriate with the applicable charge.
- 8.2.6 Finally, P.A. SOLUTIONS bear all responsibilities and obligations towards you and provided for by the civil code for the seller. Especially, in the event of a defect in the product we sell, you can:
- Ask for it to be repaired without any charge or to replace it with another unless this is impossible or requires disproportionate costs
- Request a reduction in price
- Request a withdrawal unless it is an insubstantial actual defect
The above responsibilities and obligations do not apply if the defect is caused by you or by force majeure. In any case, the products must be accompanied by the necessary legalization documents and receipts. These obligations are in any case interrupted within two years.
9. Product prices
The product pricing policy of P.A. SOLUTIONS is the same in its natural and online stores. Prices on the website www.pasolutions.gr include VAT. If you are a wholesale customer (B2B), you can also choose to view prices without VAT.
In any case, although we make every effort to accurately display the items and prices we list in our online store, we can not rule out the possibility of typographical or technical errors in price and product features. 10. Product availability
